Purpose *
When creating a partnership for a band or group, you can include your live performances as part of the partnership or have them as a separate entity. Many bands conduct their touring operations though a separate corporation or limited liability company due to the liability protection that those entities provide. Or if you will require performers for your live show, and would like them to have the opportunity to become 'members' of the band but not own recordings and naming rights you might consider separation.
Exclusivity *
The Partners need to decide if the services of each member are exclusive to the group. This issue should be given serious consideration.
Decision Making *
The Partners need to have a clear understanding and agreement as to how the decisions are made.
Music Publishing Rights *
This will determine how songs written by the group for albums recorded by the group will be split up in regards to credit and royalties. It will not include on songwriters who are not in the group.
Seeking Legal Council *
